Agreement dated as of _____________ between (your name) _______________________________________________ (hereinafter referred to as "CLIENT") and Discovery Services (hereinafter referred to as, "AGENCY")

1. AGENCY shall provide CLIENT with investigative services, which may result in: videos, photographs, written reports, statements, documents and related materials, as set forth by the terms and conditions below.

2. CLIENT preferences for the method of submitting reports, documentation and any information resulting from this investigation: ___________________________________________________________________________________

3. CLIENT agrees to pay AGENCY for all work undertaken at the rate of $50/hr and .40/mile, billed at quarter hour increments plus all associated expenses, regardless of the outcome of said services. CLIENT agrees to pay a retainer of $________ against costs, before AGENCY shall commence any work on behalf of CLIENT. Payment of any overdue amount is due upon receipt of the final report or are subject to a one and one-half percent (1-1/2 %) interest charge per month, for the unpaid balance. Client further agrees to pay all costs of collection plus reasonable attorney fees. AGENCY reserves the right to retain all reports, documentation and information from the CLIENT, until payment has been made and the contract, if requested, has been received. It is agreed that any and all court appearances resulting or arising from this investigative request are billed at the rate of $75 per hour, plus mileage and all related expenses.

4. AGENCY will keep and maintain all conversations, discussions and reports strictly confidential, except where required by law, unless CLIENT gives express consent.

5. CLIENT will use all information from this investigation for lawful purposes only. CLIENT will not use this information to cause harm to persons or property.

6. AGENCY will attempt to provide complete and accurate reports pursuant to this agreement. CLIENT acknowledges the understanding that information contained in such reports may be obtained from sources including, but not limited to: public records, nonproprietary services and through observation or perception, which may require the exercise of judgment of interpretation. CLIENT further releases AGENCY, its officers, employees, and affiliated companies and any companies or individuals from which AGENCY obtains information included in a report, from the liability arising or alleged to arise directly or indirectly from any negligent acts, errors, or omissions by any of the providers of information or AGENCY, in connection with the preparation of any reports, written or verbal.

7. By requesting this investigation, the CLIENT agrees to indemnify and hold harmless AGENCY, its officers, and employees from any and all claims, liabilities, expenses, fees including attorney fees, costs, and judgments arising from CLIENTS use or possession of the information furnished as a result of this investigative request.

8. The CLIENT will furnish AGENCY with true and accurate information to the best of CLIENTS knowledge and ability at the time of this agreement. AGENCY reserves the right to decline, or withdraw from any assignment at any time, for any reason. CLIENT understands that knowingly supplying false, misleading or incomplete statements or information to AGENCY relating to said assignment may result in immediate termination of this assignment and the forfeiture of all retainers and money paid to AGENCY.

9. CLIENT agrees to inform AGENCY of and information regarding: A) whether the subject of the investigation has a criminal history or is wanted by any law enforcement agency; B) any information regarding the subjects history of violence; C) any information regarding the subject's history with respect to the ownership or firearms, or the use/sales of illicit drugs.

10. CLIENT further asserts that this investigative request is a lawful one; that there are no court orders/restraining orders in effect for either the CLIENT, the subject(s) of the investigation, or anyone involved in this matter, in any way. If court orders affect the CLIENT, then the CLIENT agrees to provide a copy of the court document, and any related documents, as requested.

11. The CLIENT understands that the AGENCY makes no guarantee of results.

12. AGENCY reserves the right to terminate this contract at any time, for any reason. If the termination is the result of the discovery of having received misinformation from the client, then all deposits are forfeited, otherwise the AGENCY will submit the unused portion of the retainer to the CLIENT, along with the final report. In the event that Client requests suspension or termination of the services with at least 48 hours notice, then the unused balance of the retainer will be returned to the CLIENT. If the CLIENTS notice to suspend or terminate services is less than 48 hours from when the investigation is scheduled to begin, then a $100 charge is incurred and will be deducted from the retainer. A $200 charge will be incurred for such a notice given to the AGENCY at less than 24 hours prior to the scheduled beginning of the investigation.

Client does hereby bind his/her heirs, executors and legal representatives to the terms of this contract as set forth herein.
